EL USUARIO: El acceso, la navegación y uso del Sitio Web, confiere la condición de usuario (en adelante, Usuario), por lo que este acepta desde que inicia la navegación en el mismo todas las Condiciones aquí establecidas y sus ulteriores modificaciones, sin perjuicio de la aplicación de la correspondiente normativa legal que aplique al presente caso. El Usuario declara tener capacidad legal para celebrar contratos a través de este sitio Web.

2. PROCESO DE COMPRA: El Usuario puede comprar el Sitio Web por los medios y formas establecidos. Para ello, deberá seguir el procedimiento de compra establecido durante el cual podrá añadir al carrito, cesta o espacio final de compra cuantos productos y/o servicios considere. El Usuario deberá rellenar y/o comprobar la información que en cada paso que se le solicita a efectos de ejecutar su compra. Posteriormente, el Usuario recibirá un correo electrónico confirmando que se ha recibido su pedido o solicitud de compra y/o prestación del servicio que será considerado como confirmación del pedido realizado. El Usuario reconoce en el momento de la compra ser conocedor y acepta de las condiciones particulares del producto y/o servicio en cuestión.

3. DISPONIBILIDAD: Todos los pedidos de compra recibidos por esNatheu a través del Sitio Web se encuentran sujetos a la disponibilidad de los productos y/o servicios. Si se produjesen dificultades en cuanto al suministro de los mismos, esNatheu, contactará con el Usuario y reembolsará cualquier cantidad que pudiera haber sido abonada en concepto de importe para dicho producto y/o servicio.

4. PRECIOS Y FORMAS DE PAGO: Los precios exhibidos en el sitio Web son los finales, en euros e incluyen los impuestos correspondientes. Los precios pueden cambiar en cualquier momento, pero los posibles cambios no afectarán a los pedidos o compras con respecto a los que el usuario ya haya recibido una confirmación de pedido. El cobro de este importe no garantiza que la compra esté realizada. Los medios de pago aceptados serán: (i) PAYPAL y (ii) Tarjeta de crédito o débito a través de la pasarela de pago STRIPE. Después de confirmar el pedido el cliente será conducido, a la web de PayPal aprovechando su plataforma de pago seguro. Paypal puede retener un importe a modo de fianza o seguro al intentar realizar una compra con la tarjeta en la plataforma PayPal (aproximadamente un euro). Este importe lo reembolsará PayPal en un mes aproximadamente. El cobro de este importe no garantiza que la compra esté realizada.

5. ENTREGA: En los casos en los que proceda realizar la entrega física del bien contratado, las entregas se efectuaran en el ámbito de España (Península y Baleares). A efectos de las presentes condiciones se considerará que se ha producido la entrega en el momento en el que el usuario o un tercero indicado por este adquiera la posesión material de los productos, lo que se acreditará mediante firma de la recepción del pedido en la dirección de entrega convenida.

6. DEVOLUCIONES: En el supuesto de tratarse de un bien con soporte físico, el Usuario dispone de un plazo de 14 días naturales para desistir de la compra realizada en el Sitio Web. el plazo computará desde la entrega del mismo. En el supuesto de tratarse de un producto y/o servicio online, al ser un servicio personalizado y/o de acceso inmediato a parte o a la totalidad de los material, referido derecho de desistimiento desaparece siendo conocedor el Usuario de dicha circunstancia y aceptándola en el momento de realizar la compra correspondiente. Para ejercitar este derecho de desistimiento al que se ha hecho referencia y cuando éste proceda, el Usuario deberá notificar su decisión con una manifestación expresa y clara a esNatheu, dentro del plazo establecido a tal efecto y al mail: nathalie@esNatheu.com. El reembolso al Usuario será mediante el mismo método de pago utilizado por éste en el momento de realizar la transacción inicial de compra. No se procederá a realizar ningún reembolso si el producto ha sido usado más allá de la mera apertura del mismo, de productos que no estén en las mismas condiciones en las que se entregaron o que hayan sufrido algún daño tras la entrega.

7. EXONERACIÓN DE RESPONSABILIDAD: Salvo disposición legal en contrario, esNatheu no aceptará ninguna responsabilidad por: (i) pérdidas no atribuibles a incumplimiento alguno por su parte; (ii) pérdidas empresariales (incluyendo lucro cesante); (iii) fallos técnicos por causas fortuitas o de otra índole que impidan un normal funcionamiento del sitio web a través de internet. Falta de disponibilidad del sitio web por razones de mantenimiento u otras, que impida disponer del servicio; (iv) ningún incumplimiento o retraso en el cumplimiento de alguna de las obligaciones asumidas, cuando se produzca como consecuencias que se encuentran fuera de su control razonable, es decir, que se justifiquen en causa de fuerza mayor.

PROPIEDAD INTELECTUAL E INDUSTRIAL: Los contenidos del sitio web www.esNatheu.com, incluyendo entre otros las imágenes y los textos de los artículos, cualesquiera que sea su formato, lenguaje de programación y forma de representación, son propiedad de esNatheu, o bien ha adquirido los correspondientes derechos de sus propietarios, y están protegidos por las leyes y tratados internacionales en materia de propiedad intelectual. 12. LEGISLACIÓN APLICABLE Y JURISDICCIÓN: La relación entre la empresa y el Usuario se regirá por la normativa española vigente y cualquier controversia se someterá a los Juzgados y Tribunales de la ciudad de Valencia.
